Please read these terms carefully before using the Homeo AI Clinic platform. These terms govern all use of our services.

1. Acceptance of Terms

By accessing or using the Homeo AI Clinic platform ("Platform", "we", "us") at homeoaiclinic.com, you ("User", "Patient") agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform. These Terms constitute a legally binding agreement under the Information Technology Act, 2000, and the Consumer Protection Act, 2019 of India.

2. Description of Services

Homeo AI Clinic provides an AI-assisted homoeopathic case analysis service. The Platform allows patients to submit clinical information (text, images, audio, medical reports) for AI-assisted analysis. All AI-generated outputs are reviewed by a licensed BHMS physician before being shared with patients. We do not provide allopathic, emergency, or substitute medical services.

3. Eligibility

You must be 18 years of age or older to create an account and submit a case independently. Minors may use the Platform only with explicit consent of a parent or legal guardian who accepts these Terms on their behalf. By registering, you warrant that the information you provide is accurate and complete.

4. User Account & Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at [email protected] if you suspect unauthorised access. We reserve the right to suspend or terminate accounts found to be in violation of these Terms, used fraudulently, or posing a risk to platform integrity or other users.

5. Medical Disclaimer & Limitations

The Platform is an AI-assisted clinical intelligence and decision-support tool. All outputs are indicative and for informational and clinical assistance purposes only. They do not replace a physical consultation, diagnostic tests, or emergency care. A licensed BHMS physician reviews every AI analysis before prescription issuance. Homeo AI Clinic is not liable for outcomes arising from self-prescription or misuse of platform-generated information. Always consult a qualified healthcare professional for any health concern.

7. Fees & Payment

A nominal base fee of $0.99 / ₹25 is charged for standalone AI case analysis to cover high-performance LLM processing and infrastructure costs. When you book a video consultation with a doctor, a telehealth platform and AI clinical report fee of $0.99 / ₹25 is added to the physician's stated consultation fee. Doctors set their own consultation fees subject to the platform minimum floor of ₹200 ($10). All prices are inclusive of applicable GST. Payments are securely processed via verified gateways (PayU, Cashfree, Razorpay, Stripe, or PayPal).

8. Cancellation & Refund Policy

Our detailed Cancellation and Refund Policy is available at homeoaiclinic.com/refund and is incorporated into these Terms by reference. In summary: (a) the base consultation fee is non-refundable once AI processing has commenced; (b) if the physician review has not commenced within 72 hours of payment, a full refund may be claimed; (c) refunds, where applicable, are processed within 5–7 business days to the original payment method. This policy is consistent with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

9. Prohibited Conduct & Anti-Scraping

You agree not to: (a) submit false, misleading, or fabricated clinical information; (b) deploy automated crawlers, scrapers, bots, spiders, or data mining software to extract repertory rubrics, remedy relationship mappings, Materia Medica texts, or clinical prompts; (c) reverse-engineer, decompile, disassemble, or derive the source code or algorithms of the Platform; (d) use any platform content, repertorization outputs, or API responses to develop, train, fine-tune, or benchmark any third-party artificial intelligence, machine learning model, or competing healthcare software; (e) impersonate a medical professional; (f) share AI-generated reports publicly without proper medical context and disclaimer; (g) attempt unauthorized access to other users' data, circumvent rate limits, or probe platform security.

10. Intellectual Property & Database Compilation Rights

All Platform source code, software architecture, clinical reasoning engines, system prompts, AI algorithms, vector embeddings, branding, logos, trademarks, and documentation are the exclusive intellectual property of Homeo AI Clinic and Dr. G.K. Gyan. Furthermore, while historical homeopathic source texts are public domain, the normalized database schema, hierarchical rubric taxonomy, synthesis of 104,298 classical rubrics, 1,197,810 graded mappings, and 820 structured remedy relationships constitute an original database compilation protected by the Indian Copyright Act, 1957, the Berne Convention, and international copyright and trade secret laws. Any unauthorized extraction, re-hosting, or commercial reproduction is strictly prohibited and constitutes willful infringement. Patient-submitted data remains the property of the patient, licensed to Homeo AI Clinic solely for the purpose of providing clinical consultations and regulatory compliance.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Homeo AI Clinic, its operators, and licensed physicians shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform. Our total aggregate liability in any matter arising out of or related to these Terms shall not exceed the fees paid by you in the 30 days preceding the claim.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by mutual negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in the city where the clinic is registered. The courts of competent jurisdiction in India shall have exclusive jurisdiction for any matters not subject to arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Platform at least 15 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
